中國(guó)外交部副部長(zhǎng)劉振民稱，菲律賓南海仲裁(庭)與位于海牙的常設(shè)仲裁法院(Permanent Court of Arbitration，PCA)不是一個(gè)系統(tǒng)。常設(shè)仲裁法院可為仲裁庭提供秘書服務(wù)(secretarial service)，比如菲律賓南海仲裁庭在庭審(trial)的時(shí)候使用了常設(shè)仲裁法院的大廳。劉振民還表示，菲律賓南海仲裁庭的組成實(shí)際上是一個(gè)政治操作的結(jié)果(a result of political manipulation)。5名仲裁員中的4名是由國(guó)際海洋法法庭(the International Tribunal on the Law of the Sea)時(shí)任庭長(zhǎng)、日本籍法官柳井俊二指定，而柳井俊二是日本安倍政府安保法制懇談會(huì)會(huì)長(zhǎng)。國(guó)際法院和海洋法法庭的法官的酬金、薪水是由聯(lián)合國(guó)支付的，目的是保證他們的獨(dú)立性、公正性(independence and impartiality)。而這五名仲裁員是提供有償服務(wù)(paid services)，掙的是菲律賓的錢，可能還有其他方面給的錢。
